The Child Maintenance and Other Payments Act 2008 (Commencement No.16) Order 2018 brings into force s 27 of the Child Maintenance and Other Payments Act 2008, inserting new ss 39B to 39G into the Child Support Act 1991.

 

Focus on pre-proceedings to ensure right cases in court, urges McFarlane

Community Care – 26 November

Sir Andrew McFarlane, the new President of the Family Law Division, has called for ‘more scrutiny of which cases come to court’. McFarlane has stated his priority is to address the volume of care order applications and that there needs to be a bigger focus on pre-proceedings.

 

1.3 million women and 695,000 men experienced domestic abuse in last year

Family Law Week – 25 November 

A recent Crime Survey for England and Wales (CSEW) has revealed in the year up to March 2018, 1.3 million women and 695,000 men experienced domestic abuse. Women were four times more likely to have experienced sexual assault, and male victims reported a higher level of force than their female counterparts. In the last six years, the number of reported cases of domestic abuse has reduced drastically.

 

Law Society publishes briefing on Mental Capacity (Amendment) Bill

The Law Society has published a parliamentary briefing on the Mental Capacity (Amendment) Bill. The briefing has reached the report stage in the House of Lords and aims to amend the Mental Capacity Act 2005 in relation to deprivation of liberty and a person lacking the capacity to consent.
