Consent of birth parents dispensed with in granting adoption order

High Court grants foster parents an adoption order in respect of 17-year-old boy, and dispenses with the consent of the birth parents to the adoption, on the grounds that:(a) he had been in the care of the foster parents for practically all of his life; (b) he had significant ties to his foster family, and regarded himself as a de facto a member of the family; and (c) he was opposed to being reunited with his birth parents.

Plaintiff falsely accused of sexually abusing daughter could maintain claim against investigating Garda

Court of Appeal: (a) allows appeal from High Court, and sets aside dismissal of claims made against a Garda who had arrested the plaintiff arising from false allegations by his wife that he had sexually abused his daughter, on the grounds that, although no claim could be maintained for misfeasance in public office, the pleadings could be amended to bring a claim seeking damages for wrongful arrest and imprisonment; but (b) dismisses an appeal from a decision of the High Court to strike out a claim against the Health Services Executive arising from the same issues.

Working group report did not confer rights on residency applicants

High Court refuses application for an injunction restraining the deportation of a Georgian national pending the determination of her application for residency or the application to revoke the deportation order issued against her, on the grounds, inter alia, that the recommendations contained in a working group report was not equivalent to official government policy, and did not confer rights on applicants.
