Promontoria (Oyster) DAC v McHale [2021] IECA 95 (Court of Appeal (civil), Collins J, 26 March 2021)
The Court of Appeal has dismissed an appeal from the High Court declaring property to be well-charged, on the grounds that registration of the lien constitutes ‘conclusive evidence’ that the title of the registered owner is subject to such lien, and the fund was entitled to rely on the register to establish conclusively that it was the holder of a statutory lien registered as a burden on the folio.
