December Issue of IT/IP Update Now Available

The latest issue of Intellectual Property and IT Law Update is now live for subscribers of Intellectual Property and IT Law.

The team at William Fry have written an article entitled ‘In My House, I Make The Rules’: Who can request information in intellectual property rights disputes?’. It centres on an opinion from Advocate General Rantos (the ‘AG’) in the case of TB ('TB') and Castorama Polska Sp z. o.o. (‘Castorama’) and Knor Sp z. o.o. (‘Knor’) (Case-628/21).

The AG's opinion clarifies the extent to which an applicant must substantiate its intellectual property rights ('IPR') holder when making an application for information under Article 8(1) of Directive 2004/48/EC of the European Parliament and of the Council on the enforcement of intellectual property rights (the 'Directive'). The AG's opinion is only advisory in nature and does not amount to a full ruling of the European Courts of Justice of the European Union ('CJEU').

Trial Judge was Entitled to Make Finding of Dishonesty in Conduct of Solicitor

Law Society of Ireland v Coleman [2022] IECA 277 (Court of Appeal (civil), Binchy J, 7 December 2022)

The Court of Appeal, in solicitors disciplinary proceedings, having allowed further submissions in light of recent case law, found no basis to interfere with the finding in its principal judgment of dishonest conduct, on the grounds that: (a) the appellant admitted certain facts, the knowledge of which met the subjective element of the legal test established in case law; (b) the facts admitted were in terms of allegations that the appellant accepted connoted dishonesty; (c) the trial judge did not conclude that the appellant was guilty of dishonest conduct on the basis of a test of strict liability; and (d) there was no question of a retrospective application of a new test of dishonesty.
