April Issue - Irish Company and Commercial Law Update

The latest online update is now available to subscribers of Irish Company and Commercial Law and discusses the case of De Lacy, Declan v Hevey, Garret and Davit Peile. 

Arden Forestry Management Limited defrauded creditors by offering investments in forestry schemes allegedly operated by the company. Investors paid a combined total of €6,432,745 believing that these funds had gone to acquire interests in forestry. The High Court ruled that two persons jailed for fraudulently operating the forestry firm should be made personally liable for some or all of the company’s debts. In his judgment, Mr Justice Brian O’Moore said the company was operated in an ‘utterly fraudulent way’.

Not in Best Interests of Children to be Returned to Ireland Despite Unlawful Removal to Poland

In re J and K; W.A. v. A.T. (Child Abduction: Best Interest of the Children) [2024] IEHC 142 (High Court (General), Gearty J, 13 March 2024)

High Court refused to order the return of two children from Poland, to where they had been unlawfully removed in 2016, to Ireland, on the grounds that it was not in their best interests of the children to leave a country where they had all their connections and schooling.

Child abduction – application for return of boys from Poland – unlawful removal in 2016 – failure to return after Christmas visit despite refusal of relocation order – best interests of children.

April Issue of the IP and IT Law Update

The team at William Fry discuss social media and registered designs. The decision in Puma v EUIPO should draw the attention of design applicants. An application must be filed without delay from the date on which the design is first unveiled (e.g. on social networks). The aim is to prevent self-disclosure from invalidating the application for lack of individual character. Read more in the April issue of the Intellectual Property and IT Law Update.
