Costello v MacGeehin [2022] IEHC 442 (High Court (General), Heslin J, 23 June 2022)
The High Court refused an application to dismiss professional negligence proceedings arising from solicitor’s failure to issue personal injury proceedings for delay on the grounds that although the delay was inordinate the solicitors failed to establish that the delay was inexcusable and the balance of justice favoured the continuance of the within proceedings.
