The Court of Appeal allowed an appeal against the severity of a sentence for manslaughter in the context of a burglary, on the grounds that: (a) it was of little practical effect whether the label of aggravating or reduction of mitigation is applied to absconding; and (b) the appellant was in the company of older adults, including his father and this serves to reduce the moral culpability.
