Court of Protection Law Reports

The Court of Protection Law Reports are updated quarterly

Court of Protection Law Reports is a series of reports covering every aspect of the law, practice and procedure before the Court of Protection, as well as key cases determined in other courts shedding material light upon the jurisdiction of the Court.

The Court of Protection has now been in existence in its current form since 1 October 2007. Complex issues of the interpretation and application of the Mental Capacity Act 2005 are determined by the Court of Protection on a very regular basis. Further, the judges of what is still a relatively new court are required to address the novel and difficult procedural points that arise from the securing of the interests of those with cognitive impairments.

With case reports judicially approved before publication, the Court of Protection Law Reports provide practitioners and the judiciary with reliable headnotes and concise summaries of the issues involved and the points of law raised. They include all significant cases engaging health and welfare issues, as well as property matters and financial affairs. Where relevant, they also include appellate level decisions and decisions of other courts shedding light on the substantive and procedural jurisdiction of the Court of Protection.

The reports are published four times a year and are available in print and digitally, as part of Bloomsbury Professional’s Family Law online service or as a standalone product.
