Issue 67 of Irish Planning Law and Practice is now live for subscribers.
The 67th issue of O'Sullivan & Shepherd: Irish Planning Law & Practice updates the text up to 31 October 2023. There continues to be a huge volume of Irish and European case law in this important area, as well as additional Regulations. Most importantly, at the time of compiling this Issue, the Planning and Development Bill 2023, first published in December 2022, and since revised very considerably, was published in December 2023. It is currently being debated in the Dáil. That legislation will entirely replace the Planning and Development Act 2000 and lead to many changes in our current law. It is likely to be effective by mid-2024. We await publication of the accompanying Regulations.
Also in December 2023, the Planning and Environmental Division of the High Court was officially launched. This is effectively a continuation of the SID environmental and planning list which has been operating in the High Court for the last number of years. It continues to be very busy, with three full time High Court judges appointed to manage it. A revised Practice Direction has recently been signed by the High Court President, PD 124, and legal practitioners in this list should make sure to comply with it.
